Best Practices Using CCDC 2 2020 For Construction In Canada

This session will appeal to anyone in consulting who uses CCDC 2 and supplementary conditions for their projects.

Description

This best practices approach will review and investigate solutions that work in the field to ensure productivity of contractors, accountability of contractors and subcontractors, balanced with proper payment procedures and fairness in dealing with construction disputes. Each participant will receive an education version copy of CCDC 2 - 2020

The course will cover more specifically, the following:

  • Optimizing Part 5 - Payment to work with prompt payment requirements in Ontario specifically, while paving the way for other provinces to adopt best practices 
  • Filling out Article A-3 Contract Documents right the first time
  • Article A 6 Notice Requirements - Why use Notice Provisions, and how to use them properly to ensure your position is well established 
  • Properly Applying and leveraging General Condition 1.1.5 Conflict Within Contract Documents when facing a dispute of discrepancy in the contract documents. 
  • Role, timeline and responsibility of the consultant to make a first determination. 
  • Role of the owner
  • Role of the contractor.

Using a real-world role play, we will attempt settle a dispute in real time, using the levers built into CCDC 2.

Derek Smith, President/Lead Facilitator - Constructionlab

Offering clients  over 25 years of construction industry experience in Canada,  Derek is a trained design professional having practiced for over 15 years of his career collaborating on over $300 million in built or contemplated ICI and residential projects.  As the CEO of the London & District Construction Association (2007-2012) he acted as employer bargaining agent to General Contractors in a successful strike free round (2010).  In 2009 Derek led the development of Canada's first BIM training lab to be housed in an industry association and at the same time founded the Canada BIM Council (CANBIM).   Derek is also a recognized mediator, in construction disputes and holds membership with ADR Institute of Ontario.   His work has led to developing a firm commitment to balancing interests of project stakeholders, leading to improved on-site and organizational productivity.  In 2020, Constructionlab Ltd. founded the Construction and Design Educators Council of Canada, with a mission of connecting educators, storytellers, mentors and affiliates to professional and workforce development opportunities for the industry from coast to coast to coast.
